2. Data Controller and Data Processor

For the purposes of the General Data Protection Regulation (GDPR) and other data protection laws:

  • The Customer (Employer): The organization or entity that subscribes to our Service to manage their workforce is the Data Controller. They determine how and why employee data is processed.
  • TECSOL Software LLC (ClockIt): We act as the Data Processor. We process data on behalf of the Customer and in accordance with their instructions to provide the Service.

3. Information We Collect

We collect information primarily to provide our workforce management and time-tracking services. This includes:

A. Employee Data

When a Customer adds an employee to the Service, or when an employee uses the Service, we may collect:

  • Personal Identifiers: Name, email address, phone number, employee ID, and profile photograph.
  • Time and Attendance Data: Clock-in and clock-out times, break times, and total hours worked.

B. Biometric Data

To prevent "buddy punching" and ensure secure attendance tracking, our Service may use biometric technologies:

  • Facial Recognition: We use facial recognition technology on ClockIt hardware devices and our mobile applications.
  • Fingerprint Data: We may use fingerprint scanning on compatible ClockIt hardware terminals.

Note: Biometric templates are encrypted and stored securely within our systems. This data is used solely for identification and verification purposes during clock actions.

C. Location Data (GPS)

We collect location data to verify where employees are working:

  • At Clock-In/Clock-Out: We capture the precise GPS location when a user performs a clock action (Start Shift, End Shift, Break).
  • Geofencing: If enabled by the employer, the Service monitors location in the background only while you are clocked in. We are notified if you leave a designated work location (geofence) to trigger reminders or automatic actions.
  • No Tracking While Off-Clock: We do not track or store your location when you are in "Clocked Out" status.

D. Usage and Device Data

We automatically collect certain information when you access the Service, such as IP address, browser type, operating system, and device identifiers. We use cookies and similar technologies (e.g., Google Analytics, Microsoft Clarity) to analyze usage patterns and improve our platform.

4. How We Use Your Information

We use the collected information for the following purposes:

  • To provide, operate, and maintain the Service.
  • To verify employee identity and attendance for payroll accuracy.
  • To provide customer support (via Intercom) and respond to inquiries.
  • To process billing and payments (via Stripe).
  • To monitor the usage of our Service and detect, prevent, and address technical issues.

We do not process payroll directly. We provide the necessary attendance data to the Customer or their payroll provider.

5. Data Sharing and Third Parties

We do not sell, trade, or rent your personal information to third parties. We share data only with trusted third-party service providers (Sub-processors) required to operate our Service:

  • AWS (Amazon Web Services): For secure data hosting and infrastructure.
  • Stripe: For payment processing.
  • Intercom: For customer support services (Name and Email only).
  • Google Analytics & Microsoft Clarity: For website analytics and user experience improvements.

We may also disclose information if required by law or in response to valid requests by public authorities (e.g., a court or government agency).

6. Data Retention

We retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy.

  • User data is retained as long as the Customer's account is active.
  • Upon deletion of an account by the Customer, we delete the associated data from our systems. We do not retain data after account termination.

7. Your Data Rights

Depending on your location (including the European Economic Area, UK, California, and others), you may have rights regarding your personal data, such as:

  • The right to access the personal data we hold about you.
  • The right to request correction of inaccurate data.
  • The right to request deletion of your data.

Employee Requests: Since ClockIt is the Data Processor, if you are an employee wishing to exercise your rights, please contact your employer (the Data Controller) directly. We will assist the Data Controller in fulfilling these requests.

8. Security

We take the security of your data seriously. We implement industry-standard technical and organizational measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure.

9. Children's Privacy

Our Service is intended for use by businesses and their employees. It is not designed for children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal data from a child under 13, we will take steps to delete that information.

Users under the age of 18 but of legal working age may use the Service under the supervision of their employer and in compliance with local labor laws.
