Pennsylvania's minimum wage is $7.25 per hour, matching the federal rate that has applied since July 24, 2009. The tipped cash wage is $2.83 per hour, higher than the federal $2.13. Bills to raise the state minimum have been introduced repeatedly but none had passed as of mid-2026, and state law preempts cities like Philadelphia and Pittsburgh from setting their own private-sector rates.

Pennsylvania's Minimum Wage Act (PMWA) requires 1.5x pay after 40 hours in a workweek; there is no daily overtime. The PMWA is stricter than the FLSA in some respects: Pennsylvania does not permit the fluctuating workweek (half-time) overtime method for salaried non-exempt employees, and it lacks the FLSA's highly-compensated employee and computer professional exemptions.
Pennsylvania's own higher exempt salary thresholds were repealed in 2021, so the federal FLSA threshold of $684 per week ($35,568 per year) applies. Note that some FLSA exemptions (computer employees, highly compensated employees) do not exist under the PMWA.
The enforced FLSA exempt salary threshold is $684 per week ($35,568 per year). The 2024 DOL rule that briefly raised it to $1,128 per week was vacated by federal courts in Texas in late 2024, and the DOL formally withdrew the rule on May 14, 2026, restoring the 2019 level.
Pennsylvania's minimum wage is $7.25 per hour in 2026, the same as the federal minimum wage. It has not changed since July 24, 2009. Proposals to raise it (including to $15.00) have been debated in Harrisburg but had not become law as of mid-2026.
Tipped employees in Pennsylvania can be paid a cash wage of $2.83 per hour, provided tips bring them to at least $7.25. Since August 2022, an employee must receive at least $135 per month in tips (up from $30) before an employer may use the tip credit, and the 80/20 rule limits non-tipped side work.
There is no scheduled increase. Pennsylvania's minimum wage only changes if the state legislature passes a new law or the federal minimum wage rises. Several increase bills were pending in the 2025-2026 session, but none had been enacted as of July 2026.
Yes, unless properly exempt. Exempt status generally requires a salary of at least $684 per week ($35,568 per year) plus meeting a duties test. Pennsylvania is stricter than federal law for salaried non-exempt workers: employers cannot use the fluctuating workweek half-time method and must pay full 1.5x overtime.
Not for private employers. Pennsylvania state law preempts local minimum wage ordinances, so the $7.25 state/federal rate applies to private-sector work statewide. Philadelphia's higher wage standards apply only to city workers and certain city contractors.
