British Columbia Labour Compliance

BC's Employment Standards Act (RSBC 1996) is enforced by the Employment Standards Branch. BC has daily overtime rules similar to California, and a robust statutory holiday and statutory pay framework.

1Daily & Weekly Overtime

BC requires overtime pay at 1.5× the regular rate for time worked beyond 8 hours in a single day, and 2× for time beyond 12 hours in a day. Weekly overtime (1.5×) also applies for hours beyond 40 hours per week. The higher of the daily or weekly calculation applies to any given period.

2Minimum Wage

BC's general minimum wage is $17.40/hour from 1 June 2024. Liquor server minimum wage is $15.20/hour. BC indexes its minimum wage to CPI annually. Farm workers paid by piece rate have separate minimum earnings requirements.

3Statutory Holidays

BC has 10 statutory holidays per year. An eligible employee who does not work on a statutory holiday receives statutory holiday pay (average daily wages over the 30 calendar days before the holiday). An employee who works the holiday receives their regular wages plus 1.5× for the time worked.

4Vacation Pay

Employees are entitled to 2 weeks of vacation after 1 year (4% of gross earnings) and 3 weeks after 5 years (6% of gross earnings). Vacation pay must be paid at least 7 days before the vacation starts, or on the regular paydays if the employee takes vacation days intermittently.
