WA has a dual industrial relations system: the national Fair Work system covers most private employers, while state-registered employers (sole traders, partnerships, and some state-owned corporations) are covered by the WA Industrial Relations Commission and the Minimum Conditions of Employment Act 1993.
Under the Long Service Leave Act 1958 (WA), employees are entitled to 8.67 weeks of paid LSL after 10 years. A pro-rated entitlement applies after 7 years for employees who resign or are dismissed on grounds other than serious misconduct. Annual leave loading of 17.5% does not apply to LSL.
